Terms and Conditions for Event Ticket Sales

These terms and conditions (“Terms”) govern the sale and use of tickets (“Tickets”) for events (“Event”) organized by Japan Karate Association (JKA) Australia Inc. (ARBN: 604 856 395)(Incorporated Association Number: A0055214W)  (“Organizer”). By purchasing a Ticket, you agree to be bound by these Terms.

1. Ticket Purchase:

1.1 Tickets can be purchased online through Trybooking.com, subject to availability.

1.2 Ticket prices are as advertised and include any applicable taxes. Additional fees, such as booking fees or processing fees, will be disclosed at the time of purchase.

1.3 All sales are final. Tickets are non-transferable and non-refundable, except as required by law.

2. Attendee Responsibilities:

2.1 Attendees must comply with all rules, regulations, and instructions provided by the Organizer and venue staff during the Event.

2.2 Attendees are required to complete the Organizer’s Waiver, Release, and Indemnity form (“Release Form”) before participating in the Event. By completing the Release Form, attendees agree to waive, release, and discharge the Organizer from any and all claims, liabilities, damages, or losses arising from or in connection with their attendance at the Event.

2.3 Attendees are responsible for their own transportation, accommodation, and other expenses associated with attending the Event.

3. Event Changes and Cancellations:

3.1 The Organizer reserves the right to make changes to the Event schedule, lineup, venue, or any other aspect of the Event without prior notice. In the event of a significant change or cancellation, reasonable efforts will be made to notify Ticket holders.

3.2 In the event of cancellation of the Event, Ticket holders will be entitled to a refund of the Ticket price, excluding any booking fees or other charges, in accordance with applicable laws, including the Australian Consumer Law.

4. Use of Tickets:

4.1 Tickets are valid only for the date, time, and location specified on the Ticket.

4.2 Tickets must be presented upon entry to the Event. The Organizer reserves the right to refuse entry to any person without a valid Ticket.

4.3 Lost, stolen, or damaged Tickets may not be replaced or refunded.

5. Liability:

5.1 To the extent permitted by law, the Organizer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with the sale of Tickets or attendance at the Event.

5.2 Nothing in these Terms excludes, restricts, or modifies any guarantee, warranty, term, or condition implied or imposed by any legislation, including the Australian Consumer Law, which cannot lawfully be excluded or limited.

6. Privacy Policy:

6.1 The Organizer collects and processes personal information provided by Ticket purchasers and attendees in accordance with its Privacy Policy. By purchasing a Ticket and attending the Event, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy.

7. Governing Law and Jurisdiction:

7.1 These Terms shall be governed by and construed in accordance with the laws of [State], Australia.

7.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of [State], Australia.

8. Severability:

8.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

9. Entire Agreement:

9.1 These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, whether written or oral.

By purchasing a Ticket to the Event, you acknowledge that you have read, understood, and agreed to these Terms.
